Overview

Welcome to ScareScreen. The terms “we,” “us,” and “our” refer to Ecom Guidé, operating under the brand name ScareScreen. Ecom Guidé operates this online store and website, including all related information, content, features, tools, products, and services (collectively, the “Services”). Our store is hosted by Shopify, which enables us to provide the Services.

These Terms of Service (“Terms”), together with the policies referenced in them, explain your rights and responsibilities when you use the Services. Please read them carefully because they contain important information, including disclaimers and limitations of liability.

By visiting, interacting with, or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, you must not access or use the Services.

Nothing in these Terms excludes, limits, or overrides any consumer right or remedy that cannot lawfully be excluded in the country, state, province, or territory where you live.

Section 1 — Access and Accounts

You must be at least the age of majority in your place of residence to place an order, or place an order with the involvement and consent of a parent or legal guardian where permitted by law.

You may be asked to provide information such as your email address and billing, payment, and shipping details. You agree that the information you provide is accurate, current, complete, and that you have the right to provide it.

You are responsible for protecting your account credentials and for activity occurring through your account. You may not sell, transfer, assign, or license your account to another person.

Section 2 — Products

We make reasonable efforts to display our products accurately. However, colors, scale, brightness, and appearance may vary depending on your screen, device, settings, lighting, projection surface, and environment.

Product images, videos, and demonstrations are illustrative. Actual projection visibility and image quality may vary based on ambient light, projection distance, surface, source content, and setup. Product descriptions do not replace the specifications, instructions, or safety information supplied with the product.

We may update product descriptions, discontinue products, or limit available quantities where permitted by law. Any such decision does not affect an order already accepted by us or your mandatory consumer rights.

Section 3 — Orders

Submitting an order is an offer to purchase. We may accept or reject an order for legitimate reasons, including product unavailability, suspected fraud, pricing errors, payment failure, shipping restrictions, or legal requirements. Your order is accepted when we send an order confirmation stating that it has been accepted or shipped, depending on the checkout process used.

Payment must be authorized before an order can be processed. Please review your order carefully before submitting it. We may be unable to change or cancel an order after processing begins.

If an order is refused, changed, or cancelled, we will attempt to contact you using the information supplied at checkout and will issue any refund required by applicable law.

Purchases are subject to our Refund Policy and Shipping Policy. Products are sold for personal or household use and not for unauthorized resale.

Section 4 — Prices, Currency, Taxes, and Billing

Prices, discounts, and promotions may change without notice before an order is placed. The price charged will be the price displayed and confirmed at checkout, subject to correction of an obvious error as permitted by law.

The checkout page will identify the transaction currency. Your bank or payment provider may charge currency-conversion or international-transaction fees that we do not control.

Unless expressly stated otherwise, product prices may exclude shipping charges, taxes, customs duties, import taxes, brokerage fees, or other government charges. Any amount collected by us will be shown at checkout. If duties or import charges are not prepaid, the recipient may be responsible for them where permitted by law.

You agree to provide accurate and current purchase, payment, and account information. You represent that you are authorized to use the selected payment method and agree to pay all charges shown at checkout.

Section 5 — International Shipping and Delivery

We may ship to supported international destinations shown at checkout. Availability, shipping methods, and delivery estimates vary by destination.

Delivery dates are estimates unless we expressly state that a date is guaranteed. Customs processing, carrier disruptions, weather, address errors, public holidays, and events outside our reasonable control may cause delays. We will remain responsible to the extent required by applicable consumer law.

The customer is responsible for providing a complete and accurate delivery address. If a parcel is returned because of an incorrect or incomplete address, additional shipping charges may apply where permitted by law.

Risk of loss passes to you only when the order is delivered to you or a person you designate, except where applicable law provides otherwise or you independently arranged a carrier not offered by us.

Section 6 — Returns, Refunds, and Mandatory Consumer Rights

Returns and refunds are governed by our Refund Policy. Any voluntary commercial guarantee we offer is additional to, and does not replace, mandatory legal rights.

Customers in certain jurisdictions may have non-waivable cancellation, conformity, repair, replacement, refund, or legal-guarantee rights. For example, qualifying consumers in the European Union generally have a 14-day withdrawal right for many online purchases and a minimum legal guarantee for goods, subject to statutory conditions and exceptions. Where local law gives you greater protection than our policy, local law applies.

Section 7 — Safe and Proper Product Use

You agree to read and follow all instructions, warnings, electrical requirements, and safety information provided with the product. Unless the product is expressly identified as weather-resistant, keep it dry and protected from rain, snow, condensation, excessive humidity, and extreme temperatures.

Use the projector on a stable, ventilated surface. Do not block ventilation openings, look directly into the lens while operating, use a damaged cable, or allow children to install or operate the product without appropriate adult supervision.

Section 8 — Intellectual Property

The Services and their content, including our original text, graphics, photographs, videos, layouts, branding, and software, are owned by or licensed to Ecom Guidé and are protected by applicable intellectual-property laws.

We grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Services for personal, non-commercial purposes. You may not reproduce, distribute, modify, republish, scrape, sell, or commercially exploit our protected content without prior written permission or another lawful basis.

Third-party names, logos, and marks belong to their respective owners. No license to use the ScareScreen name, branding, or content is granted except as expressly stated in these Terms.

Section 9 — Optional Third-Party Tools

We may provide access to tools or services operated by third parties. Those tools may be offered “as is” and “as available,” subject to the third party’s own terms and policies.

Your use of optional third-party tools is at your discretion. To the maximum extent permitted by law, we are not responsible for third-party tools that we do not own or control.

Section 10 — Third-Party Links

The Services may contain links to third-party websites or services. We do not control and are not responsible for their content, accuracy, availability, privacy practices, products, or services.

Review the third party’s terms and policies before completing a transaction. Complaints concerning a third party’s products or services should be directed to that third party, without limiting any rights you may have against us under applicable law.

Section 11 — Relationship With Shopify

ScareScreen is powered by Shopify, which enables us to provide the Services. However, purchases made through our store are transactions directly between you and Ecom Guidé.

To the maximum extent permitted by law, Shopify is not responsible for the products sold by ScareScreen or for losses arising from a transaction between you and Ecom Guidé. Nothing in this section limits rights or claims that cannot lawfully be excluded.

Section 12 — Privacy

Personal information collected through the Services is handled according to our Privacy Policy. Shopify may also process personal information as described in its Privacy Policy.

Because we sell internationally and use service providers that may operate in multiple countries, personal information may be processed outside your country of residence. Our Privacy Policy explains the categories of information collected, purposes of processing, service providers, international transfers, retention, cookies, and available privacy rights.

Section 13 — Reviews, Feedback, and User Content

If you submit a review, image, video, suggestion, or other content (“User Content”), you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, reproduce, adapt, publish, display, and use that content to operate and promote the Services, subject to applicable privacy and consumer laws.

You represent that you own or have permission to submit the User Content, that it is accurate to the best of your knowledge, and that it does not violate another person’s rights or applicable law. You must disclose any incentive or compensation connected to a review.

We may moderate or remove User Content that is unlawful, fraudulent, abusive, obscene, misleading, infringing, malicious, or unrelated. We will not suppress genuine negative reviews merely because they are unfavorable.

Section 14 — Errors and Inaccuracies

The Services may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, prices, promotions, shipping charges, delivery estimates, or availability.

We may correct errors and update information. If an error materially affects an accepted order, we will notify you and provide any cancellation or refund rights required by applicable law.

Section 15 — Prohibited Uses

You may not use the Services to:

  • violate applicable law or another person’s rights;

  • submit false, fraudulent, defamatory, abusive, or malicious content;

  • impersonate another person or misrepresent your identity;

  • transmit malware or interfere with the security or operation of the Services;

  • collect personal information about others without authorization;

  • send spam, phishing messages, or unauthorized solicitations;

  • circumvent security, access controls, rate limits, or robot-exclusion measures; or

  • reproduce, scrape, resell, or commercially exploit the Services without permission or another lawful basis.

We may suspend or terminate access where we reasonably believe these Terms have been violated, subject to applicable law.

Section 16 — Automated Agents

Automated or semi-automated systems may not access or interact with the Services in violation of our technical controls, published instructions, or applicable law. An automated agent must not conceal its automated nature, bypass a CAPTCHA, evade access restrictions, or imitate a human in order to circumvent controls.

We may restrict automated access to protect customers, security, availability, intellectual property, and the integrity of the Services.

Section 17 — Suspension and Termination

We may suspend or terminate access to all or part of the Services where reasonably necessary, including for security, fraud prevention, legal compliance, non-payment, or a material breach of these Terms.

Termination does not affect rights, remedies, payment obligations, or provisions that by their nature should survive, including intellectual property, disclaimers, limitations of liability, indemnification, severability, governing law, and privacy obligations.

Section 18 — Disclaimer of Warranties

To the maximum extent permitted by law, the Services are provided on an “as is” and “as available” basis. We do not promise that the website will always be uninterrupted, timely, secure, or error-free.

Except for express warranties we provide and warranties that cannot lawfully be excluded, we disclaim implied warranties and conditions, including merchantability, fitness for a particular purpose, durability, title, and non-infringement.

This section does not exclude statutory guarantees, legal warranties, or remedies that apply to consumers and cannot be waived.

Section 19 — Limitation of Liability

To the maximum extent permitted by law, Ecom Guidé, ScareScreen, and their officers, employees, affiliates, agents, contractors, suppliers, service providers, and licensors will not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses, or for lost profits, revenue, savings, goodwill, or data, arising from the Services or products.

Where liability cannot be excluded, it is limited only to the extent permitted by applicable law. Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, gross negligence or intentional misconduct where applicable, death or personal injury caused by negligence where such liability cannot be excluded, defective products where liability is mandatory, or any other liability that cannot lawfully be excluded.

Section 20 — Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Ecom Guidé, ScareScreen, Shopify, and our respective affiliates, officers, employees, agents, contractors, licensors, and service providers from third-party claims, losses, liabilities, and reasonable legal costs arising from your unlawful use of the Services, your material breach of these Terms, or your violation of another person’s rights.

This section does not require a consumer to indemnify us for our own breach, negligence, unlawful conduct, or responsibilities that cannot be transferred under applicable law.

Section 21 — Severability

If any provision of these Terms is found unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted or severed if necessary. The remaining provisions will continue in effect.

Section 22 — Waiver and Entire Agreement

Our failure to enforce a provision is not a waiver of that provision. These Terms and the policies incorporated by reference form the entire agreement between you and us regarding the Services, except where applicable law provides otherwise.

Section 23 — Assignment

You may not assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms as part of a merger, acquisition, restructuring, sale of assets, or other lawful business transfer, subject to applicable law and without reducing your mandatory consumer rights.

Section 24 — International Consumers

International customers retain any mandatory protections, rights, and remedies provided by the laws applicable to them. Nothing in these Terms requires a consumer to give up a right or forum that cannot lawfully be waived.

Section 25 — Changes to These Terms

We may update these Terms by posting a revised version on this page. Where required by law, we will provide notice of material changes. The “Last updated” date identifies the latest revision.

Changes apply prospectively from their effective date and do not remove rights already acquired under an accepted order or applicable law.
